Terms and Conditions

Kindly read the terms and conditions carefully as they are made up of the agreement between you and Travel Nest and Tour Limited.

BOOKINGS AND DOCUMENTS

Bookings are only considered confirmed once we have received the required payment from you. We have the right to cancel your reservation and keep 100% of the original payment if the balance is not received 14 days prior to the departure date. You are expected to evaluate every component of your reservation to confirm important details, such as passenger names, itineraries, email addresses, phone numbers, etc. If there are any errors in the booking details that need to be corrected, kindly notify the company right away. You accept complete and exclusive responsibility for all risks and/or expenses associated with failing to report such errors and/or omissions on time or at all.

PAYMENT/PRICING

Every payment must be deposited into the business's corporate account, which has the account name TRAVEL NEST AND TOUR LIMITED. The business takes checks, and bank transfers as forms of payment. On our website and through email-delivered Pay-stack payment pages, we might also accept payments. The Company assumes no liability for payments made to any third party on its behalf without its express authorization, save from the procedures set forth for payment by the Company. You acknowledge that your reservation will be immediately subject to cancellation if payments are not made on time. You willingly release the Company from liability for any cancellation of a reservation due to a creditcard's decline or late payment.

Based on the information that was available to the company at the time of quoting, the company's prices and availability are stated. Therefore, until full payment has been received, such rates and availability are not guaranteed. Any variations, inaccuracies, or omissions in any quotes or ads, including pricing indicated on the company's marketing materials and/or website, are not the company's responsibility.

TRAVEL INSURANCE

It is your obligation to purchase travel insurance to protect against illness, accidents, and other insurable events as well as loss or damage to luggage. We accept your reservation on the condition that you have enough insurance coverage, and we will not be held responsible or liable for any acts or omissions that result from your failure to get such coverage. The policy document of the insurer will be sent to you once the insurance has been validated by the insurer in cases where you have paid for a package that includes insurance policy payment. As a result, you and the insurer are the parties to the insurance contract. You acknowledge that the Company is not the insurer's agent and won't be held responsible for whatever the insurer does or doesn't do. The consumer will only have recourse against the insurers if the insurers dispute their liability for any reason.

FLIGHT TIMES AND OTHER TRAVEL DATES

The timing of flights is provided by the airlines and is constrained by ATC. The weather can affect any mode of transportation. It is the client's duty to arrive at the airport by the appointed time and check in promptly. There is no assurance that any itinerary or tickets you obtain will leave at the times indicated for flights, ferries, cruises, trains, or coaches. Where timeframes are given, they are simply approximations, and we disclaim all responsibility for delays of any kind or changes to the program.

TICKETS AND STOPOVERS

Once the airline has accepted your payment and granted you a ticket, you agree that the airline policy will control your itinerary and that the contract relating to the ticket is solely between you and the airline. As a result, all concerns, including but not limited to missed flights and baggage-related problems, must be resolved in accordance with airline rules. However, the Company may step in to help you and the airline reach a quick and peaceful resolution. You acknowledge that the Company is not liable for any of your losses as a result of any intervention by the Company.

Unless the airline specifically allows for another option, airline tickets are typically non-refundable and non-transferable. The airline alone has the authority to change passenger names, dates, times, routings, or departure/arrival airports; the Company has no control over this. Your travel expenses to the airport or to any other airport where there is a connecting flight are your responsibility, unless expressly stated otherwise. You won't be able to get these fees back from the Company, and it won't be responsible if you miss your connecting flight.

You agree not to deviate from your reservation by making any unplanned lay-overs.

UNSCHEDULED EXTENTION

It is agreed that you will be responsible for paying the costs associated with any unplanned extensions of the holiday (hotel accommodations, flights, etc.) in the unlikely event that they result from flight delays, inclement weather, strikes, or any other cause outside the Company's control. We take no responsibility for modifications, omissions, or delays made prior to, during, or after any journey due to technical issues, weather conditions, strikes, communication failures, or unanticipated extensions.

SUPPLIERS

In order to make your trip and holiday special, we partner and work with suppliers who offer a variety of services. The Company merely acts as a go-between for your travel package suppliers and you. Hotels, shore excursions, tours, transportation providers, cruise lines, ships, airlines, travel insurance agencies, attractions, etc. are not owned or run by the company. You acknowledge and agree that the Company shall not be responsible for any loss, damage, delay, inconvenience, or injury to you resulting from any act or omission of any third party, including but not limited to these Suppliers, their employees, agents, servants, or representatives, that results in a breach of contract.

Despite our best efforts to choose reputable Suppliers, we make no promises, guarantees, or warranties regarding the suitability or condition of the Supplier's lodgings, means of transportation, or any food, drink, medication, or provisions supplied. You recognize and accept that the Company is not obligated to reimburse any funds paid as a result of subpar services from any supplier, either in full or in part. The Company is not responsible for any accident that happens while using any form of transportation during the trip, including but not limited to hotels, resorts, aircraft, buses, trains, and cruise ships, as a consequence of defective equipment or any other reason. The customer acknowledges having a thorough awareness of the nature and characteristics of the method of transportation and accepting full responsibility for any travel, transportation, and handling hazards.

CHANGES

Where it is practicable and within our power to do so, we may help you modify your reservation if you so desire. Keep in mind that these adjustments are subject to the supplier's rules. The vendors who provide the part of your travel arrangements that you want to amend may charge you fees of any type, so be prepared to pay them. You acknowledge that modifications to group packages are prohibited because they may have an impact on other group members. Most of the time, we might not be able to accommodate your adjustments, and we won't be held responsible if we can't because it's out of our hands.

It is our job to give you the products and services for which you have paid. If there are any changes, we will let you know and need your permission before modifying your reservation.

GROUP PACKAGE

Without the express permission of your travel advisor or tour leader, you are not permitted to prolong your stay while on our group trip. Most of the time, an extension of your stay won't be approved because the company may have promised the destination's embassy throughout the visa application process that all of its clients would return on schedule.

TERMINATION BY YOU

All no-shows or cancellations are subject to fees assessed by the supplier in accordance with the terms and conditions of the supplier. The Company will deliver the data as received if you ask for a copy of these terms.

By making the reservation, you agree to pay any cancellation charges levied by the supplier and the company.

If you want to cancel your reservation, you must do so right away by contacting your travel and tour consultant. The following cancellation fees, which are subject to change, are your responsibility:

There will be cancellation fees from the tour operator, which are typically computed on the sliding scale shown below:

Charges For Cancelling A Departure Days In Advance:

100% of the package's total price is due within 0 to 15 days.

60% of the package's total price is due between 15 and 30 days.

35% of the total price of the package is due within 31 to 60days.

You must present documentation proof to back up any claims that the cancellation was brought on by a force majeure event, illness, or death. We may make a particular cancellation request of our providers after receiving your documentation proof. Please take note that we cannot promise that any supplier will accept your documentation proof or grant your request to cancel. If our suppliers are dissatisfied with the delivered documents, they have the right to refuse and demand their fees.

REFUND RULES FOR AIRLINE AND HOTEL BOOKINGS

The different airlines and hotels have quite different refund procedures. We might help you submit a refund request to the appropriate hotel or airline for consideration. If a refund is approved, you will get it less any cancellation or administrative fees.

We cannot guarantee when a particular airline or hotel will execute a refund request.

PERSONAL TRAVEL REIMBURSEMENT (PTA)

The Company's sole obligation is to deliver all of the services it has advertised, including:

  • A round-trip ticket in economy or business class on any of the airlines we've advertised.
  • Accommodation in hotels,
  • Aid and support with visa applications,
  • Touring and sightseeing
  • Transfers to and from the airport.
  • Any supplemental services promoted by the Company that are always location-specific

The Company is not liable for your PTA or the manner in which you obtain it. You acknowledge that the Company cannot be forced to expedite the ticket or visa support processes in order to meet the PTA application deadline. You also acknowledge that the Company is not liable for your failure or inability to submit, apply for, or obtain your PTA for any reason.

TICKETS & TRAVEL DOCUMENTS RESCHEDULED

Airlines occasionally deliver tickets to the Company a few days before the trip for reasons beyond the Company's control. Please be aware that the travel date is still the same, and that any offered services, including airplane tickets, will be provided on or before the travel date, unless we tell you otherwise. Any delays in the issuance of tickets or the application for visas are not the responsibility of the company.

RENEWAL POLICY

Regardless of the reasons for cancellation, once a customer joins or subscribes to the Company's package and the Company takes action to provide visa application and other necessary support for the customer as advertised in the package, the customer will not be entitled to any refund of the payment made to the Company. Regardless of whether or not the visa has been accepted, the Company's non-refund policy is in effect.

OTHER INFECTIOUS DISEASES AND COVID-19

All payments made and committed to a trip in the event that a customer tests positive for Covid-19 or any other infectious or communicable disease prior to departure cannot be returned by the company because those payments were made to the numerous service providers who provided the trip's services.

COMPLAINTS

You must notify your travel consultant right away if you have a complaint or if you run into any difficulties during your trip. Once the deposit has been paid, you have agreed to travel on the quoted airline, stay in the hotel of your choice, and participate in all the trip's scheduled activities. Before making a payment, it is your obligation to look at the hotel photographs and read the reviews. Your travel agent will give you the hotel's name and address in-order for you to examine its quality. There will be no refunds given to you if you decide to cancel your trip because you dislike the hotel or airline.

VISAS, PASSPORTS, AND HEALTH

It is solely the responsibility of the customer to make sure that all passports and visas are up-to-date, valid, and obtained in a timely manner, and that any vaccinations, inoculations, prophylactics (e.g., for malaria), covid-19 PCR tests, have been obtained. Passports must be valid for six to nine months after you return from your vacation to your home country.

We may provide clients with assistance and direction with regard to visa requirements. We would like you to be aware that Travel Nest and Tours Limited does not grant visas and does not in any way guarantee that any of our clients will obtain a visa. As a result, the Company is not liable for refunding any visa costs or other fees that have already been paid for the processing assistance/support offered by the Company. The Company is also not liable in the event that the customer's visa application is delayed or rejected.

Changes to the agreed-upon travel itinerary would not be permitted once the client has completed and paid for their visa application. If the client insists on canceling or making changes afterward, the customer understands that doing so may result in the loss of the full deposit provided and that no refund will be given. The customer may forfeit group package benefits, such as lower hotel and airfare rates, if the requested adjustments pertain to a group package, and will be asked to pay more before traveling according to the revised itinerary. To be clear, deposits made will not be refunded at this time and will be forfeited only to the extent that the provider permits a reimbursement. Clients are therefore advised to make their changes before their visa is submitted on their behalf.

TEST FOR COVID 19

According to Covid 19 rules for airlines, you would not be allowed to travel if your test for Covid 19 or any other infectious disease is POSITIVE. Depending on the country you are in, you may be responsible for paying the date change fees for your aircraft ticket, hotel extension, or stay, as well as any associated medical expenses. Since we do not include any of these expenses in any of our packages, the Company will not be responsible for any of them. If you purchased your travel health insurance from us, we might be able to help you make a claim for the cost of your medical care while traveling, but we can't guarantee it will be approved because the insurance provider will have requirements you must meet before your claim will be approved.

POWER MAJEURE

Except as expressly provided in the booking conditions, we are not responsible or liable for failure to perform or delay in performing our contractual obligations or for any other harm or loss you may sustain as a result of force majeure. Any incident that neither we nor the service provider in question could reasonably foresee or avoid falls within the definition of force majeure. These uncontrollable occurrences could be anything from war or the possibility of war to riots, civil unrest, terrorism, real or threatened terrorist activities, industrial disputes or strikes, natural or nuclear disasters, epidemics, and fires.

MODIFICATION

The Company reserves the right to change or modify the Terms and Conditions at any moment without prior notification. Since the last time you placed an order, the terms and conditions may have changed. Therefore, it is your responsibility to familiarize yourself with the Terms and Conditions so that you are aware of what is relevant prior to making each and every booking. This is especially important to do in case the Terms and Conditions have changed since the last time you placed an order.

SEVERABILITY

If any part of this agreement is found to be invalid, illegal, or otherwise unenforceable for any reason, the offending part shall be deemed severable and shall not impact the legality or enforceability of any other parts of this agreement.

HEADINGS

The scope and extent of a section are not limited by the headings, which are merely there for reference.

RULES OF GOVERNANCE AND DISPUTE RESOLUTION

This Agreement shall be governed by, construed in accordance with, and subject to the exclusive jurisdiction of the courts of Nigeria.

Any claim or disagreement arising out of this agreement, its breach, or otherwise related thereto will in the first instance, be resolved amicably by direct dialogue between the Parties.

The disagreement will be directed to a single Arbitrator who the Parties will agree upon or appoint if it cannot be resolved amicably within 30 (thirty) days. Any of the Parties shall have the right to request the appointment of an Arbitrator by the Chairperson of the Chartered Institute of Arbitrators, Nigerian Branch in the event that the Parties are unable to reach agreement on a single Arbitrator within 30 days of a Party's demand that the dispute be referred to an Arbitrator. In making his appointment, the Chairperson shall take into consideration the nature of the dispute in question and appoint an Arbitrator who is knowledgeable and skilled in

The arbitration will take place in FCT, Abuja. Nigeria, and will be conducted in English.

The Arbitration and Conciliation Act of Nigeria and the Rules adopted pursuant thereto shall be followed in conducting the arbitration.

The parties agree to be bound by the arbitrator's decision, which is final and binding on them.

ACCEPTANCE

You acknowledge that you have read, understood, and accepted to be bound by these terms and conditions by paying the initial deposit for this package.
